Terms of Service

These are the terms for using FoundLocal. We've kept them short and plain. If something here is unclear, write to us at hello@foundlocal.dev and we'll explain.

Who we are

"FoundLocal," "we," and "us" refers to the team operating foundlocal.dev. Our contact email for all administrative and legal matters is hello@foundlocal.dev.

The service

FoundLocal designs and hosts custom websites for local businesses under a monthly subscription. The current scope, plan options, and pricing are shown on foundlocal.dev and confirmed during checkout.

Subscription and billing

The price, billing period, and payment method are confirmed when you check out. We renew automatically at the end of each billing period until you cancel. You can cancel anytime through the Customer Portal link in your welcome email. Cancellation takes effect at the end of your current billing period. Your site stays live until then.

Acceptable use

By using FoundLocal you agree not to use the service to publish or promote:

You also agree not to attempt to scrape, copy, reverse-engineer, or resell our service. If we believe you've broken these rules, we may suspend or end your subscription and refund any unused balance.

Who owns what

Our work. The underlying templates, design system, and code that we use to build sites belong to us. While your subscription is active, you have a non-exclusive license to use the rendered website we produce for your business.

Your content. Your photos, your menu, your business name, your copy, and your brand assets stay yours. You give us permission to use them only to build and host your website. If you cancel, you can ask for a copy of your content and we'll send it within seven business days.

Service availability

We host customer sites on reliable infrastructure but we don't promise a specific uptime percentage at this scope. If we have an outage that materially affects you, write to us and we'll make it right.

Liability

To the extent the law allows, our total liability to you for any claim related to FoundLocal is capped at the amount you've actually paid us in the 12 months before the claim. We're not liable for indirect, incidental, or consequential damages.

We don't warrant that the service will produce specific business outcomes (more traffic, more orders, higher rankings). We'll do our best, and we'll fix problems we cause, but the result depends on factors outside our control.

Privacy

We handle your data per our Privacy Policy. We don't sell data and we don't load third-party trackers on the websites we build.

Governing law

These terms are governed by the laws of British Columbia, Canada, and any dispute about them goes to the courts of British Columbia. If a clause here is unenforceable in your jurisdiction, the rest still applies.

Changes

If we change these terms in a way that materially affects you, we'll email active customers at least 14 days before the change takes effect. If you keep using the service after that date, you accept the new terms. If not, cancel before the effective date and contact us for a refund of any unused prepaid period.
